1 Introduction

These Terms of Service (“Terms”) govern your participation in the Wales.org Partner Programme (“Programme”) and the use of listing services provided by Wales.org (“we”, “us”, “our”). By signing up for a listing package, you (“Partner”, “you”) agree to be bound by these Terms.

Wales.org is a tourism website that promotes businesses, attractions, and experiences across Wales. Our Partner Programme allows businesses to be featured on our platform through paid listings.

2 Definitions

“Listing” means your business profile, map pin, and/or featured placement on wales.org.

“Monthly Pin” means a rolling monthly listing with your business pinned on our interactive map and a dedicated listing page, priced at £40 per month.

“Annual Pin” means a 12-month listing with your business pinned on our interactive map and a dedicated listing page, priced at £400 per year.

“Editor’s Choice” means a premium featured placement on a designated page of wales.org, with pricing agreed individually.

“Bundle” means a combined Monthly Pin and Editor’s Choice listing, with pricing agreed individually.

“Direct Debit” means the payment method used to collect fees via GoCardless.

3 Eligibility

To participate in the Programme, you must:

• Be a registered business or sole trader operating in Wales or offering services related to Welsh tourism.
• Provide accurate and truthful information about your business.
• Have the authority to enter into a legally binding agreement.
• Comply with all applicable laws and regulations, including consumer protection and advertising standards.

4 Packages and Pricing

4.1. Monthly Pin (£40/month): A rolling monthly subscription. Your listing goes live within 48 hours of payment confirmation. You may cancel at any time with immediate effect. No refunds are given for the current billing period.

4.2. Annual Pin (£400/year): A single payment covering 12 months of listing. Your listing goes live within 48 hours of payment confirmation. No refunds are given once the listing period has commenced. At the end of the 12-month period, you will be contacted regarding renewal.

4.3. Editor’s Choice (custom pricing): A premium featured placement on a designated page. Pricing is agreed individually between you and our team. Billing frequency (monthly, quarterly, or annual) is confirmed at sign-up. Minimum commitment matches the billing frequency (e.g., quarterly billing = 3-month minimum). You may cancel at any time with immediate effect after the minimum period. No refunds are given for the current billing period.

4.4. Pin + Editor’s Choice Bundle (custom pricing): A combined package including both a map pin listing and Editor’s Choice placement. Pricing and billing frequency are agreed individually. The same cancellation terms apply as the Editor’s Choice package.

4.5. We reserve the right to change pricing for new sign-ups at any time. Existing Partners will be given at least 30 days’ written notice of any price changes to their current package. If you do not agree to a price change, you may cancel your listing before the new price takes effect.

5 Payment Terms

5.1. All payments are collected by Direct Debit via GoCardless, a Financial Conduct Authority (FCA) authorised payment institution. Your payments are protected by the Direct Debit Guarantee.

5.2. Your first payment will be collected approximately 4 working days after you authorise the Direct Debit mandate. Subsequent payments will be collected on the same date each billing period.

5.3. If a payment fails, we will attempt to collect it again. If payment cannot be collected after two attempts, we reserve the right to suspend or remove your listing until the outstanding balance is settled.

5.4. All prices are stated in pounds sterling (GBP) and are exclusive of VAT unless otherwise stated. If VAT becomes applicable, it will be added to your invoice.

5.5. For telephone mandates: by providing your bank details to our sales representative, you authorise us to set up a Direct Debit instruction on your bank account via GoCardless. The sales representative will read you the Direct Debit Guarantee before processing. You will receive written confirmation from GoCardless by email.

6 Cancellation and Refunds

6.1. Monthly Pin: You may cancel at any time with immediate effect. Your listing will remain active until the end of the current paid month. No refunds are given for the remaining days of the current billing period.

6.2. Annual Pin: No refunds are given once the listing period has commenced. Your listing remains active for the full 12-month period.

6.3. Editor’s Choice and Bundle: You may cancel at any time after any applicable minimum commitment period. Your listing will remain active until the end of the current paid billing period. No refunds are given for the remaining days of the current billing period.

6.4. To cancel, you may contact us at hello@wales.org, cancel the Direct Debit directly with your bank, or notify us by phone or in writing. Cancellations take effect immediately, and your listing will be removed at the end of the current paid period.

6.5. We reserve the right to cancel your listing at any time if you breach these Terms, with or without notice. In such cases, no refund will be provided.

7 Your Listing

7.1. You are responsible for providing accurate, up-to-date information for your listing, including business name, address, contact details, description, and images.

7.2. We reserve the right to edit, reformat, or modify your listing content to ensure consistency with our editorial standards, without altering the factual content.

7.3. You grant us a non-exclusive, royalty-free licence to use your business name, logo, images, and descriptions for the purposes of displaying and promoting your listing on wales.org and associated marketing channels (including social media).

7.4. You must not submit content that is illegal, defamatory, misleading, discriminatory, or infringes the intellectual property rights of any third party.

7.5. Images must be owned by you or you must have the right to use them. You are responsible for ensuring compliance with copyright law. We accept no liability for images provided by Partners.

7.6. Listing placement, ordering, and prominence on the website are at our sole discretion, except where a specific placement has been agreed as part of an Editor’s Choice or Bundle package.

8 Our Obligations

8.1. We will use reasonable endeavours to ensure your listing is live within 48 hours of receiving all required information and payment confirmation.

8.2. We will maintain the wales.org website to a reasonable standard and ensure it is accessible to visitors.

8.4. We reserve the right to make changes to the website design, layout, structure, and content at any time without prior notice.

9 Limitation of Liability

9.1. To the fullest extent permitted by law, Wales.org shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Programme.

9.2. Our total liability to you in respect of all claims arising from or in connection with these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.

9.3. We are not liable for any loss of business, revenue, profits, data, or anticipated savings, whether direct or indirect.

9.4. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

10 Data Protection

10.1. We process your personal data in accordance with our Privacy Policy.

10.2. We will collect and process your business information, contact details, and payment information solely for the purposes of providing the listing service, processing payments, and communicating with you about your listing.

10.3. Your bank details are transmitted securely to GoCardless for payment processing and are never stored on our servers.

10.4. We may send you service-related communications (e.g., listing confirmations, payment receipts, renewal notices). If you opt in, we may also send marketing communications, from which you can unsubscribe at any time.

11 Telephone Sales

11.1. If your listing is arranged via a telephone call with one of our sales representatives, the following additional terms apply:

• The sales representative will clearly identify themselves as calling from Wales.org.
• You will be informed of the package details, pricing, and billing frequency before any payment is taken.
• The Direct Debit Guarantee will be read to you before your bank details are collected.
• You will receive written confirmation by email, including a copy of these Terms and the Direct Debit mandate details.
• You have the right to cancel within 14 days of signing up under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, provided your listing has not yet gone live at your request. If your listing has gone live at your request within the 14-day period, you acknowledge that the service has commenced and the cooling-off period no longer applies.

12 Intellectual Property

12.1. All content on wales.org, including text, graphics, logos, and software, is the property of Wales.org or its licensors and is protected by copyright and other intellectual property laws.

12.2. Your listing content remains your property. By submitting content, you grant us the licence described in Section 7.3.

12.3. You may not reproduce, distribute, or create derivative works from any wales.org content without our prior written consent.

13 General

13.1. These Terms constitute the entire agreement between you and Wales.org regarding the Programme and supersede all prior agreements and understandings.

13.2. We may update these Terms from time to time. We will notify you of any material changes at least 14 days before they take effect. Continued use of the Programme after changes take effect constitutes acceptance of the updated Terms.

13.3. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13.4. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

13.5. These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
